US Enforcement of the Bioterrorism Act

The United States Food and Drug Authority (FDA) now enforces the provisions of the Bioterrorism Act.  Previously, FDA inspectors who found violations usually informed the shipper of the new requirements but did not necessarily apply any fines or penalties.

The majority of violations will now result in the refusal of shipments and/or possible monetary penalties.

In addition to the registration provision, the 2002 Bioterrorism Act also requires food manufacturers to file prior notice with FDA before importing foods and keep records of all food shipments. In addition, the new law gives the FDA the authority to detain suspected contaminated food shipments.
