What are Fish and Fish Products?

The Export Control (Fish and Fish Products) Orders 2005 defines fish and fish products as the following:

  • fish means aquatic vertebrates and aquatic invertebrates including shellfish, aquatic amphibians and reptiles
  • fish product means a product containing fish.

What Fish and Fish Products do the Orders apply to?

The Orders apply to Fish (other than aquatic mammals) and to Fish Products for which Fish is the major component that are intended to be exported from Australia as food for human consumption. 

If a product contains some fish, how do I know if it is regulated by the Orders?

Products which contain fish are regulated if:

  1. fish comprises the largest proportion of the product by weight or volume; or
  2. fish is in such a proportion by weight or volume that if it is withdrawn from the product, it would no longer have the stated or implied characteristics.


My goods do not meet the strict definition of Fish and Fish Products, do the Orders still apply?

The Export Control (Fish and Fish Product) Orders 2005 together with other Export Control Orders allow conditions to be established to support the certification of products that do not fall within the strict definition but which may require government to government certification for access into importing countries.
