The Scheme: LCL Packing Scheme

Introduction

Section 66B of the Quarantine Act 1908 (‘the Act’) provides that the Director of Quarantine may, on behalf of the Commonwealth, enter Compliance Agreements with business entities in relation to the application of quarantine procedures to ‘goods’, which is defined to include an animal, a plant (whether moveable or not), a vessel, mail, ballast water, and any other article, substance or thing (including, but not limited to, any kind of moveable property).

Following consultation with Industry, AQIS has implemented a number of co-regulatory arrangements. The first of these was the Containerised Cargo Clearance for FCL/X Scheme, which serves to facilitate the clearance of non-commodity concerns for FCL/FCX containers. The next of these is the Automatic Entry Processing for FCL Scheme. The third scheme developed for the broking industry is the LCL Packing Scheme, which is essentially an amalgamation of the Containerised Cargo Clearance for FCL/X Scheme and the Automatic Entry Processing for FCL Scheme but pertaining to LCL consignments. All Compliance Agreements have essentially the same structure as outlined in the Compliance Agreement Framework.

The LCL Packing Scheme

The LCL Packing Scheme allows Accredited Persons, through the assessment of barrier documentation relating to LCL consignments, to:

  1. report quarantine non-commodity concerns in LCL containers, and
  2. direct those consignments for quarantine action.

The scheme enables Accredited Persons to direct entries without the need to send documents to AQIS and have one of its officers process the entry. The scheme allows Accredited Persons to assess documents relating to LCL consignments for non-commodity concerns, and, on the basis of that assessment, select an ICS processing type that relates to the action required. The Accredited Person is also able to select the required Quarantine Approved Premises (QAP) for the necessary treatment or inspection.
