Common Non-conformities under the Non-Commodity for Containerised Cargo Clearance Scheme and the Automatic Entry Processing of Commodities Scheme

By entering into a Compliance Agreement with AQIS, the Other Party agrees to operate within the outcomes and requirements of the scheme. Failure to operate within the outcomes and requirements may result in a non–conformity being incurred by the Other Party.

Below is a list of the most common non–conformities under the Non–Commodity for Containerised Cargo Clearance (Non–Commodity for CCC) Scheme and the Automatic Entry Processing for Commodities (AEP for Commodity) Scheme. For further information on each issue, refer to the Process and Outcomes Document (POD) reference listed.

Non–Commodity for CCC

Unacceptable packing declaration being accepted and presented to AQIS

An acceptable packing declaration must:

  • declare that prohibited packaging materials have not been used
  • Or

  • if timber has been used:
    • it is ISPM 15 compliant;
    • Or

    • has an acceptable treatment certificate
  • And

  • the timber is free of bark.

Packing declarations must also contain:

  • letterhead
  • unique identifiable link
  • signature
  • date

Packing declarations that do not meet these requirements must be declared to AQIS by answering NO to the second non–commodity question and selecting the correct AQIS concern type.

Non–Commodity for CCC

Incorrect use of AEP for non–commodity code RPT instead of RPNT

The AEP for non–commodity code RPNT should be used when:

  • timber packaging has not been used

Or

  • timber packaging has been used but there is no acceptable ISPM 15 statement or treatment certificate.

RPT should be used when

  • there is timber packaging

And

  • there is an acceptable ISPM15 statement or treatment certificate.

Non–Commodity for CCC

Use of AEP for non–commodity codes (VPF and VFPA) being used to direct the commodity for treatment.

The AEP for non–commodity codes VFP and VFPA can only be used to direct non–commodity components of a consignment for fumigation.

These codes can only be used when timber packaging:

  • has been declared which is not ISPM 15 compliant

AND

  • does not have an acceptable treatment certificate.

Non–Commodity for CCC

Use of AEP for non–commodity codes to direct out of scope consignments (FCX, ISO tanks and Hard Frozen Containers)

AEP for non–commodity codes can only be used for consignment types FCL and FCX.

All other consignment types (for example FCX, ISO tanks and Hard Frozen Containers) are out side the scope of the scheme and can not have an AEP for non–commodity code assigned to them.

Non–Commodity for CCC

Using the AQIS cover sheet to make non‑commodity declarations to AQIS

The cover sheet used when lodging entries is not considered as an acceptable method to make non–commodity declarations to AQIS. This is because this document is not covered under the Minimum Documentary Requirements Policy.

The only way to declare to AQIS that there are non–commodity documentation concerns or if the consignment is not being unpacked in a metropolitan area is to answer NO to the second non–commodity declaration question.

AEP for Commodities

AEP for commodity codes being applied to impediment free lines.

AEP for commodity codes can only be applied to impediment lines.

Impediment free lines are out of scope of the scheme and should not have an AEP for commodity code.

AEP for Commodities

AEP for commodity codes being applied to different commodities.

AEP for commodity codes can only be used in a consignment when all the impediment lines with an AEP for commodity code are the same. This is identified by the tariff code.

If a potential non–conformity is detected it is reviewed against the Scheme requirements as outlined in the Scheme policy documents. From this review, if it is determined that a non–conformity has occurred, an increased review rate may be imposed in accordance with the Scheme General Policies. AQIS will advise the Other Party, in writing, of the outcome.
